Title of the Job: Intellectual property analyst

Location: Montreal, QC

Job Description: Description :As the Intellectual Property Analyst, you will be responsible for Intellectual Property searches and activities designed to enhance patent protection and clearance of the company’s licensed and/or internally developed products; providing a global perspective on IP matters and policy to country, regional and international operations; advising on data protection and other forms of regulatory exclusivity; providing due diligence and transactional support and supporting court and administrative litigation efforts.Responsibilities:Advise and counsel internal clients on various Intellectual Property matters involving patents and regulatory exclusivities such as data protection and market exclusivity, including:

  • Designing and implementing well thought and creative Intellectual Property Strategies from product selection to launch considering business objectives, patent landscape, regulatory exclusivities and local regulatory requirements to ensure earliest market entry and optimal business outcome
  • Participating in pipeline product selection (either internally developed or in-licensed) by assessing generic market entry dates, regulatory submission dates and launch dates in targeted countries in view of business objectives, patent landscape, regulatory exclusivities, local and regulatory requirements
  • Advising the R&D team on formulation development in view of the patent landscape and IP stratety established to mitigate litigation risk
  • Timely and effectively communicating key changes on IP landscape affecting project timelines and litigation risks
  • Performing patentability, validity and freedom-to-operate (infringement) searches (e.g., including web, patent databases and literature searches)
  • Performing intellectual property due diligences to support business development transactions
  • Supporting internal litigation on Intellectual Property related proceedings, challenges, disputes and litigation
  • Staying current with relevant Intellectual Property legislative developments in core markets

Skills, knowledge and abilities:

  • Excellent scientific background in organic chemistry, biochemistry and/or formulation development. Preferably, the candidate will have knowledge in the following areas:
  • Concepts relating to formulation development, stereochemistry, solid state structure of active pharmaceutical ingredients (solvates, salts, hydrates, crystal/amorphous forms, polymorphs etc.), particle size distribution (PSD); X-ray powder diffraction analysis (XRD), Differential scanning calorimetry (DSC) and other analytical methods; drug bioavailability and drug metabolism
  • Basic knowledge in the following areas:
  • Regulatory exclusivities, such as data protection and market exclusivity for new pharmaceutical products in CA, US and Europe (including new chemical entities); as well as other patent related exclusivities such as orphan drug designation, pediatric extension, CSPs, etc.;
  • PMNOC Regulations in Canada and basic understanding of Hatch-Waxman litigation process in the US.
  • Bilingual (French & English) given the interactions with international external partners
  • Ability to navigate patent databases (CIPO, USPTO, EPO-Patent Register, Espacenet, Orbit/Questel/Patsnap (or equivalent), etc.) is an important asset
  • Knows and understands relevant Intellectual Property legal principles
  • Asks questions and diligently approaches clients’ matters to understand their business needs, including helping to solve unexpressed needs
  • Has ability to make complex or abstract ideas or situations clear and understandable

  • Acts as a self-starter, energetic, positive, analytical, able to drive results, and has a proven ability to work as part of a cross-functional team

  • Proficient in Microsoft Office, especially Access, Word, Powerpoint and Excel

Education : PhDExperience : 5 years: Minimum of 5 years of experience in Intellectual Property, preferably in the pharmaceutical industry. Experience in patent searches and infringement analysis is an asset.
